Justice Inyang Ekwo of the Federal High Court sitting in Abuja has declared Senator Samuel Anyanwu as the valid National Secretary of the People Democratic Party (PDP).
[ad]
Justice Ekwo, in a judgment, also made an order of injunction, restraining the national leadership of the PDP from appointing any person as acting national secretary when Anyanwu’s four-year tenure is still running and subsisting until Dec. 9, 2025, in line with the party’s constitution.
Justice Ekwo also declared that any meeting held or resolution reached by the party to prematurely remove or prevent Anyanwu from exercising the powers of his office would violate Article 47 (1) of the PDP Constitution (as amended in 2017), hence, becomes null and void and of no effect.
The judge also restrained the Independent National Electoral Commission (INEC) “from recognising any purported appointment of any person as national secretary of the party whether in acting capacity or otherwise other than Anyanwu, the elected national secretary of the 1st defendant (PDP).”
[ad]
The Court had, on Nov. 23, 2023, stopped the PDP from removing Anyanwu as national secretary pending the hearing and determination of the substantive matter.
The order followed an ex-parte motion by Dr Joshua Musa( SAN), on behalf of two members of the party; Geoffrey Ihentuge and Apollo’s Godspower.
The plaintiffs had sued the PDP; Umar Damagun, party’s acting national chairman; National Executive Committee (NEC); the National Working Committee (NWC) and INEC as 1st to 5th defendants respectively.
The plaintiffs, who sought five reliefs, prayed for an order of interim injunction, restraining the 1st, 2nd, 3rd, and 4th defendants from carrying out the threat to remove the national secretary (Anyanwu).
This, they said, was in violation of the provisions of Article 47 (1) of the Constitution of the PDP (as amended in 2017) pending the hearing and determination of the motion on notice.
[ad]
They argued that Anyanwu was duly elected on Dec. 10, 2021, and was entitled to remain in office till Dec. 9, 2025.
They said that an elected national officer of the 1st defendant cannot be arbitrarily removed from office in any manner without his resignation and in breach of the party’s constitution.
But in the 1st, 2nd, 3rd and 4th defendants’ counter affidavit, the party’s leadership averred that contrary to the plaintiffs’ argument, Anyanwu applied for leave of absence to enable him concentrate on his election as PDP candidate in the Imo governorship poll which took place on Nov. 11, 2023.
They, therefore, said that contrary to Paragraphs 22 and 23 of the plaintiffs’ affidavit, the NWC approved the deputy national secretary to act in place of the national secretary as provided for in Article 36(2) of the party’s constitution.

Meanwhile, when the matter was called for judgment, two lawyers announced appearance for parties interested to be joined in the suit.
While G.E Ejekela announced appearance for Dr Ali Odefa, the national vice chairman of South East of PDP, P.O. Akpogwu represented Hon S.K.E. Ude-Okoye, who was listed as national secretary of the party.
But plaintiffs’ counsel, Musa, called the attention of the court to Ude-Okoye’s motion for joinder filed on his behalf.
The senior lawyer said though the motion was filed yesterday, he had responded to it.
He, however, faulted the process on the grounds that the exhibits attached to the one served on him were different from the exhibits attached to other parties’.
After much arguments, Akpogwu applied to withdraw the motion for joinder and the plaintiffs’ lawyer sought a cost of N1 million but the judge awarded a N100, 000 fine against the lawyer for filing an untidy process.

Moving his motion for joinder on Odefa’s behalf, Ejekela said the application dated Dec. 22, 2023, was filed on Dec. 27, 2023. He urged the court to grant their prayer.
But Musa, who opposed the plea, said a counter affidavit had been filed.
He argued that the application was an attempt to arrest the judgment, urging the court to dismiss it for constituting an abuse of court process.
Justice Ekwo then stood down the matter for ruling and judgment.
Delivering the ruling, the judge dismissed Odefa’s motion for lack of merit and for being an abuse of court process.

In his judgement, Ekwo held that the plaintiffs had been able to demonstrate, with credible evidence, the threat and move by the PDP leadership to remove its national secretary without due compliance with the provisions of the party’s constitution.
Justice Ekwo consequently held, “The court is duty bound to prevent that from happening.
“The plaintiffs do not have to wait until the 1st to 4th defendants carry out their threat before coming to seek redress.
“In such situation, the court is bound to grant the reliefs sought by the plaintiffs.”

Yobe State Governor, Mai Mala Buni has approved a N70,000 minimum wage for workers
Yobe State Governor, Mai Mala Buni, has approved a N70,000 minimum wage for workers in the state civil service.

Nigeria sharia police to raid betting shops after court ruling
Islamic morality police in the northern Nigerian city of Kano are to resume their crackdown on betting shops after a Supreme Court ruling on gambling.
The Nigerian Supreme Court quashed a 2005 law Friday that established a national lottery commission and legalised sports betting and gambling.
The court ruled gambling regulation is a matter for state governments.
Kano State is one of 12 predominantly Muslim Nigerian states in which Islamic sharia is used alongside federal law.
“We will resume our clampdown on betting shops with renewed determination since betting is illegal under Kano state sharia law,” Abba Sufi, director general of the Kano Hisbah, told AFP.
The Hisbah is a state unit that polices Sharia law in Kano, northern Nigeria’s biggest city.
Last month, Hisbah operatives raided and closed dozens of football betting shops across the city, which they said were promoting gambling, which is prohibited under sharia.
Raids were halted after the National Lottery Commission protested that betting on football was legal under Nigerian federal law under the 2005 Lottery Act, Sufi said.
“With this verdict, the controversy on who should be in charge of lottery legislation between the federal government and state governments has been settled,” Sufi added.
“We in Kano have frowned at the lottery law… because it gave legal backing to gambling, which is clearly prohibited in Islam.”
There are around 200 betting shops across the city with television screens where customers watch international soccer matches and horse races and place bets, Sydney Emeafu, head of the National Union of Gaming and Lottery Workers (NUGLOW) in Kano, told AFP.
According to Sufi, the raids followed repeated complaints by parents of children whose love of football teams had led them into gambling.
“And the harsh economic climate is pushing more people into this football gambling, hoping to make easy money and becoming hooked to the vice,” Sufi argued.

Hafizu Inuwa, Chairman of the Jigawa Tanker Explosion Investigation Panel, has said that 209 lives were lost and 99 others injured in the accident.
The News Agency of Nigeria (NAN) recalls that on Oct. 14, a fuel tanker exploded in Majiya town killing hundreds and injuring several others.
Sequel to this, Gov. Umar Namadi constituted a 25-member investigative panel to unravel the causes of the accident and recommend measures to avert future occurrences.
Inuwa said this during the presentation of the committee’s report on Wednesday in Dutse.
He said the accident claimed 209 lives, 38 injued persons were still on hospital admission and 61 others discharged while 167 families affected.
“It was further discovered that the inferno resulted in the destruction of properties worth millions of Naira,” he said.
Inuwa attributed the accident to a number of factors, including damaged speed-breaker and potholes located near the scene.
He said the committee also identified night driving and speeding as contributory factors to the inferno.
“The inferno was possibly ignited by combined factors, including but not limited to friction of metallic containers with hard surface or other containers, as victims were scooping the spilled fuel”.
The committee, he said, recommended regular inspection and enforcement of safety protocols by petroleum transporters and other articulated vehicles.
Others include upgrade of emergency response centres, establishment of a trauma and burns units in health facilities, as well as establishment of a road traffic control agency.
“Where the victims or their relatives are seemingly old and vulnerable, government should provide them with social protection and enroll the most vulnerable victims and their relatives into the Danmodi Care Programme,” he said.
The chairman further lauded the state government for its empathy, moral and psychological support to the affected community as well as the timely response to the disaster.
Responding, Namadi promised to implement the recommendations of the committee, to ensure safety and welfare of the citizens.
NAFDAC made this disclosure on Wednesday night in a statement it shared on its official X account.
“Acting on intelligence, a NAFDAC team raided the facility, apprehending operators offloading a 20ft container filled with unregistered carbonated drinks,” the statement read.
“A further inspection revealed over 14 rooms packed with unregistered and expired products, some of which were contaminated by rats, indicating poor storage conditions.
“The facility was placed on hold, with all operations suspended pending further investigation.”
The agency said it has invited the management to provide sourcing evidence including the Global Listing for Supermarket Items (GLSI) certificate.
It also warned of the risks posed by unregulated products, particularly as the festive season approaches.
NAFDAC has further urged consumers to remain vigilant by verifying product sources and reporting suspicious activities to its nearest office.
